Agreement made this day_________________ between ______________________________________________herein after named the
landlords and ___________________________________________________________________________________________________
________________________________________________________________________________herein after named the tenants.
The landlord and tenants agree as follows:
1. The landlord hereby leases to the tenants the premises located at__________________________________________________
2. The term of this lease agreement shall extend from AUGUST 28,2010 (classes start Sept. 1) to the day of graduation 2011. Early occupancy, for sports or PSU approved activities, will be August 21 , 2010 with written prior approval from the Off Campus Rentals office This is a full school lease, not a semester lease. It is the tenant’s sole responsibility to verify that they are permitted to live off-campus.
3. Rent:
The tenants shall pay to the landlord the sum of _______________________ in full payment for the term of the lease payable as follows: Rents are due on above listed dates regardless of financial aid arrangements the tenants may have with the university or other parties.July 1st, 2010_________________________________________________________________

4. There will be a late payment fee of $5.00 per day. There is a return check charge of $20.

(Off Campus Rentals, LLC is payment agent for the owners.)
5. Security Deposit. The security deposit for this apartment is $____________($300 per tenant), _______________payable at signing and
_________________ by ____________________. This money will serve as a security deposit and will be held in a Northway Bank Savings Account. Any conditions in the rental unit in need of repair or correction should be given to the landlord in writing within 5 days of occupancy. The security deposit will be returned with interest (going rate) to the tenants after they have vacated the property, providing the tenants have met all the conditions of the lease, and have left the property clean, undamaged, and in good order. The unit must be left in the same condition as found at occupancy . Landlord may void lease if security deposits are not paid by above specified date.
By accepting the terms of this agreement and having made the security deposit, the tenants relinquish any claim concerning the security deposit should the tenants either fail to occupy the premises as agreed or fail to pay the balance due as specified above (except as stated in paragraph #6.) Furthermore, the tenants recognize their agreeing to a joint tenancy: i.e., all provisions of this lease agreement applicable to the tenants shall be shared in common--jointly. If for any reason a tenant fails to take occupancy, or leaves during the year or fails to pay on time, it is up to the remaining tenants to pay the delinquent rent, find a replacement, or enforce the lease against the absent tenant.
6. Between the signing date of this lease and graduation day 2010, the Landlord, at his sole discretion, may void this lease and return the deposit money if there are lease violations at an Off Campus Rentals apartment or at any other apartment at which a prospective tenant may reside,
7.. Tenants acknowledge that a copy of the EPA pamphlet "Protect Your Family from Lead Paint in Your Home" was available at the lease signing location.
8. The persons on the lease are the only ones to be living in the apartment. The tenants are allowed to substitute within their membership if given written landlord approval. An individual who becomes a substitution to this lease agreement is agreeing to all of the terms herein stated, just as though having been an original member (a signer of the lease) of the joint tenancy. This provision that allows for substitutions in the membership shall not be construed as permitting subletting, which is prohibited. A "rerental" fee may be assessed.
9. Heat (fuel oil) and electricity will be paid by the landlord. All exterior doors and windows must be kept closed starting November 1 until the end of PSU spring break. Landlord may enter during times of vacancy, especially winter vacation, to assure heat is working and thermostat is set at a safe temperature. Tenants must turn thermostat down to 55 degrees when apartment will be vacant for more that 12 hours. There may be a $100/tenant fuel surcharge if thermostat is not turned down. The costs that result from excessive flagrant use of utilities may be charged back to the tenants.
10. The landlord will plow driveways and parking areas.Snow and ice removal from exterior stairs and walkways is not only the sole responsibility of the tenants but is also recognized by the tenants as required for the safety of all who inhabit, visit, or travel the accesses to the premises. To this end the landlord shall provide a snow shovel and salt or sand as the need arises. In any event, the landlord shall not be held responsible or liable for any injuries or damages resulting from a mishap due to failure of the tenants to remove snow and ice on steps and walkways.
11. It is understood and agreed that the landlord shall not be held responsible or liable for any damage or injury to the tenants, their agents, or guests. Further, the landlord assumes no responsibility for any loss or damage to the tenants' personal property. Tenants are encouraged to maintain tenant insurance if they are not covered under parents’ policy. Landlord’s policy does not cover tenants’ personal property loss for any reason (fire, theft, vandalism, flood etc.) Residents shall report hazardous situations immediately to the landlord, and take any necessary precautions to avoid injury and or loss.
12. There shall be no bottles, cans or trash on lawns or adjacent sidewalks or curb areas at any time.
13. In general, the landlord is responsible for maintaining and repairing the premises in order to maintain habitable conditions. This includes the electrical, plumbing, and heating systems. Tenants are responsible for any damage to the interior or exterior of their apartment whether caused intentionally or by neglect by themselves or guests. Concerning good housekeeping and cleanliness, the tenants shall maintain acceptable standards both in regard to the interior spaces of the premises and those exterior spaces immediately adjacent to the premises. Damage to the house or property may be grounds for immediate eviction. Any and all damage to the apartment must be reported to landlords within 24 hours of occurrence. Any necessary repairs will be made immediately and billed to tenants with payment due within 7 days of receipt.
14 The tenants shall not keep any dogs or ferrets in or at the premises. One neutered or spayed cat is allowed. Caged animals permitted.
15. Excessive noise or other disturbances causing annoyance to other tenants or neighbors is prohibited. No loud outdoor music is allowed. No outdoor gatherings on lawns or porches after 9 PM are permitted.
16. Sororities and fraternities may not rent from Off Campus Rentals.

17. The landlord may enter premises at all reasonable times to view them or show them to parties wishing to lease or make repairs or to check the mechanical systems
18. Walls may not be painted by tenants. Tenants shall not drive nails, screws, etc., into walls or make any structural changes in the building. Push pins and picture hooks in moderation are permitted. Game tables, such as pool, foose ball, or beirut boards (beer boards) or dart boards are not allowed. .
19. Smoking is not allowed by tenants or their guests at any time inside premises or enclosed porches. This provision will be strictly enforced.
20. This apartment has strict occupancy limits.
There shall at no time be more than _______ occupants (total of guests and tenants present) in said apartment, or on premises. (Family members or relatives do not apply to this total.) Guests are allowed only if a tenant is present in the apartment.21. There may be no keg or large alcohol parties on or in the premises at any time.(Large is defined as having more than the allowed number of persons (paragraph #20) present in the apartment.) It is understood that all tenants in a unit may be evicted for the first breach of this policy. Kegs, draft balls, and mini kegs (empty or full) are not permitted on the property at any time.
22. No walking on roofs. Only appropriate outdoor lawn furniture allowed on lawns and porches. (No couches etc.).
23. Fire alarms, carbon monoxide detectors and extinguishers will be working at occupancy, and must not be disabled, modified or tampered with by the tenants. Candles, incense and halogen lamps are not allowed for fire/safety reasons. Propane tanks ( gas grill etc.) must be stored outside. Gas grills may not be used within 10 feet of a structure. Charcoal grills are not allowed. Extension cords must be short, in good shape and not put under rugs.
24. No electric heaters, car heaters, air conditioners or exterior lights are allowed. (Judicious use of Christmas lights excepted).
25. Tenants agree not to install locks, and to not remove any existing locks, without the prior written consent of landlord.
26. No guns, firearms, ammunition or fireworks, drugs or drug paraphernalia may be stored and/or used on the premises at any time. Trampolines, horseshoes, swimming or wading pools are not permitted.
27. No signs, posters, or letters visible from the exterior are allowed without written permission of landlord. Street signs shall not be displayed inside apartments. Electrical cords or cables may not be routed in or out of windows.
28. In the event of eviction, tenants will be liable to the landlord for all rents due as stated in this lease, plus attorney’s fees, and collection costs.
29. Any written notices of lease violations may be sent home to parents or guardians.
30. Saving Clause: This lease shall be construed to be in accordance with the laws of the State of New Hampshire. If any provision or provisions of this lease are deemed to be in violation of any law, then only those provisions shall be void and all other provisions shall remain in full force and effect.

31. Attic and basement and garage areas may be used, at tenants’ risk, for storage only (not for habitation or gatherings.).
32. If tenants store personal belongings in the premises over the summer, it is done so entirely at tenants risk.
33. No illegal acts or dangerous activities may take place on the premises. Alcohol use is restricted to tenants 21 and over. Drunken or disorderly conduct is not permitted by tenants or guests.
34. Health and Safety Inspections: The landlord will be granted access to the apartment during times of obvious activity to verify compliance with the lease. The purpose of such inspections is to insure the health, safety and welfare of both the tenants and the apartment. Failure to allow access will be considered a breach of this lease.
35. Notices hand delivered to an apartment will be considered hand delivered to each tenant. Off Campus Rentals uses e-mail to communicate and should be checked regularly. .
36. Nothing in this lease agreement will be construed as prohibiting the landlord from hiring an agent or manager to act on the landlord’s behalf.
37.The landlord is wholly responsible for taxes, sewer and water services and rubbish removal, and driveway plowing. The tenants are wholly responsible for telephone and television cable services. (For telephone/DSLservice call Verizon 1-800-474-9999, for cable call

38.Parking permits will be issued only for cars registered in the tenants or tenants parents’ names. Parking is permitted only in designated areas. Tenants must display the Off Campus Rentals stickers provided on the rear window of their cars. Stickered parking only between 12 midnight and 12 noon Monday thru Friday. Overnight guest parking not permitted during restricted hours. Cars must be moved daily during and after snowstorms. No unregistered or non-working vehicles, hazards, or eyesores are permitted on the premises. Towing will be at the tenant’s, or vehicle owner’s expense. This apartment will receive up to _______ parking stickers. Assigned parking spots may be off premises. If tenants leave mid-year parking passes must be returned.
